After Kentucky Governor Matt Bevin signed an “informed consent” law requiring women to consult with their doctor at least 24 hours before getting an abortion, Kentucky State Representative Mary Lou Marzian introduced a “protest” bill to put equally restrictive conditions on men seeking erectile dysfunction (ED) drugs, including Viagra, Cialis, Levitra and Avanafil.

Restrictions on ED drugs

House Bill 396 would require doctors to limit distribution of prescriptions for ED medications as follows:

  1. Only married men would be allowed to get a prescription for erectile dysfunction drugs.
  2. Men would be required to have two office visits with their doctor on two different calendar days before they could receive a prescription for ED medications.
  3. Men would be required to get consent from their current spouse—including a signed and dated document—before receiving a prescription for Viagra, Cialis, Levitra or Avanafil.
  4. Placing their hand on a Bible, men would need to make a sworn statement saying they would only use their prescription for ED drugs to use when having sexual relations with their current spouse.

Marzian, who is a nurse, acknowledges that the bill was designed to point out that the original “informed consent” bill was supported by a predominantly male General Assembly.

According to an article in the Courier-Journal, Marzian’s comments mirrored her sentiment about the one-sided law. “I want to protect these men from themselves,” she was quoted as saying, along with “This is about family values.”

Legitimate concerns

House Bill 396 isn’t entirely without merit. It does, for example, point out that erectile dysfunction can be prevented or decreased in many cases just through a change in lifestyle. That’s because factors like smoking, diabetes, obesity, drug use, heart conditions and alcohol use can all contribute to impotence.

In addition, Pharmacy Times reports that certain drugs are associated with erectile dysfunction, most commonly, SSRIs, lithium, tricyclic antidepressants, beta-blockers, monoamine oxidase inhibitors and any medications that affect testosterone.
