Yet hovering over the industry are big questions: Do they work? Are they safe? And if they aren\u2019t, what are the other options?<\/span><\/p>\n<h3>What Are Weight Loss Supplements?<\/h3>\n<p><a href=\"https:\/\/cohenhealthcarelaw.com\/fda-ftc-law\/dietary-supplements-claims-and-labeling\/\"><span style=\"font-weight: 400;\">Legally speaking<\/span><\/a><span style=\"font-weight: 400;\">, a dietary supplement, for weight loss or otherwise, is a product you consume that isn\u2019t presented as food and is clearly marked to \u201csupplement\u201d what you eat. A meal replacement shake, for example, isn\u2019t considered a supplement, even if it makes weight loss claims.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It also explicitly has to be labeled a \u201cdietary supplement\u201d and needs to have one or more of the following:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vitamins<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Herbs or botanicals, such as flowers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Minerals<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amino acids<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Anything that can be developed from the above, like a concentrate or extract<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The legal definition is what matters because dietary supplements don\u2019t have to be approved by the Food and Drug Administration (FDA). The FDA <\/span><a href=\"https:\/\/www.fda.gov\/consumers\/consumer-updates\/it-really-fda-approved\"><span style=\"font-weight: 400;\">states on its website<\/span><\/a><span style=\"font-weight: 400;\"> that supplements have to demonstrate they\u2019re safe to consume, and their facilities have to pass inspection. Otherwise, supplement makers can do what they want.\u00a0<\/span><\/p>\n<h3>Do Weight Loss Supplements Have to Prove Their Claims?<\/h3>\n<p><span style=\"font-weight: 400;\">The Federal Trade Commission (FTC) has <\/span><a href=\"https:\/\/www.ftc.gov\/business-guidance\/resources\/dietary-supplements-advertising-guide-industry#b\"><span style=\"font-weight: 400;\">regulations<\/span><\/a><span style=\"font-weight: 400;\"> on what supplements are allowed to claim on the bottle, and they <\/span><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2022\/03\/ftc-proposed-order-stops-marketers-continuing-promote-supplements-using-baseless-health-claims\"><span style=\"font-weight: 400;\">do enforce them<\/span><\/a><span style=\"font-weight: 400;\"> when they receive a complaint. However, it\u2019s not a perfect system.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, someone needs to complain for them to investigate, picking out individual brands instead of regulating the entire industry. Secondly, the law on what triggers an FTC investigation is more nuanced than you might think.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Supplement claims are sorted into four types:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Disease (\u201cCures the flu!\u201d)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Function and structure (\u201cCalcium builds strong bones!\u201d)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Health claims (\u201cLowers your cholesterol!\u201d) which can be qualified (\u201cResearch shows oats lower your cholesterol!\u201d)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nutrient content (\u201c100g of soluble fiber per serving!\u201d)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">A product making health claims will get shut down pretty fast. You might remember a popular cereal claiming it lowered cholesterol <\/span><a href=\"https:\/\/www.abajournal.com\/news\/article\/fda_warns_general_mills_over_cheerios_cholesterol_claims\"><span style=\"font-weight: 400;\">before the government stepped in<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFunction and structure\u201d is a different matter, especially if they\u2019re qualified. Pull a vitamin C supplement off the shelf, and you\u2019ll notice statements like, \u201cHelps support your immune system.\u201d This is <\/span><a href=\"https:\/\/www.frontiersin.org\/articles\/10.3389\/fimmu.2020.574029\/full\"><span style=\"font-weight: 400;\">absolutely true<\/span><\/a><span style=\"font-weight: 400;\"> as far as it goes, but it <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/23440782\/\"><span style=\"font-weight: 400;\">won\u2019t prevent colds<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Therein lies the gray area with supplements. Their phrasing and language are designed to encourage you to make assumptions, and if those assumptions are wrong, it\u2019s not their problem.<\/span><\/p>\n<p><a href=\"https:\/\/www.edrugstore.com\/blog\/wp-content\/uploads\/2022\/05\/2.jpeg-11_11zon-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-32733\" title=\"Man holding pills\" src=\"https:\/\/www.edrugstore.com\/blog\/wp-content\/uploads\/2022\/05\/2.jpeg-11_11zon-1.jpg\" alt=\"Man holding pills\" width=\"600\" height=\"400\" srcset=\"https:\/\/www.edrugstore.com\/blog\/wp-content\/uploads\/2022\/05\/2.jpeg-11_11zon-1.jpg 600w, https:\/\/www.edrugstore.com\/blog\/wp-content\/uploads\/2022\/05\/2.jpeg-11_11zon-1-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<h3>Are Weight Loss Supplements Safe?<\/h3>\n<p><span style=\"font-weight: 400;\">If weight loss supplements are made in the U.S., their facilities are inspected by the FDA, so they have to meet or exceed safety regulations in preparing their products. That doesn\u2019t mean they\u2019re safe, however.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, St. John\u2019s wort is a popular herbal treatment for depression, yet it can <\/span><a href=\"https:\/\/www.mayoclinic.org\/drugs-supplements-st-johns-wort\/art-20362212\"><span style=\"font-weight: 400;\">interfere with an enormous number of drugs<\/span><\/a><span style=\"font-weight: 400;\">. And as medical knowledge advances, substances previously thought safe can turn out to be dangerous.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This also assumes what\u2019s on the label is what\u2019s in the bottle, and that\u2019s not always true. In 2015, the New York State Attorney General\u2019s office tested herbal supplements from major retailers and found most of them <\/span><a href=\"https:\/\/ag.ny.gov\/press-release\/2015\/ag-schneiderman-asks-major-retailers-halt-sales-certain-herbal-supplements-dna\"><span style=\"font-weight: 400;\">didn\u2019t have any detectable level of herbs<\/span><\/a><span style=\"font-weight: 400;\">. Many were almost entirely filler.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Supplements shipped from overseas usually haven\u2019t been inspected, and fraud and tainted products are commonplace. Scientists have found a few consistent problems.<\/span><\/p>\n<h4>There\u2019s little research that proves supplements work<\/h4>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/10.1002\/oby.23110\"><span style=\"font-weight: 400;\">2021 systematic review<\/span><\/a><span style=\"font-weight: 400;\"> of dietary supplements studies struggled to find much high-quality research on the effects of dietary supplements, good or bad. In fact, out of 1,743 papers the review evaluated, only 52 met the standards required.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Of those, only 16 noted any sort of effect on weight, and in all of them, the results weren\u2019t good.<\/span><\/p>\n<h4>The ingredients rarely work as advertised<\/h4>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/ods.od.nih.gov\/factsheets\/WeightLoss-HealthProfessional\/\"><span style=\"font-weight: 400;\">an extensive fact sheet<\/span><\/a><span style=\"font-weight: 400;\"> from the National Institutes of Health (NIH), most popular weight loss supplement ingredients show, at best, a \u201cmodest\u201d effect on weight in the studies it looked at. Some of them haven\u2019t been researched extensively enough to make a call one way or the other.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The NIH also notes that these ingredients rarely have much research behind them. When they do, it\u2019s usually for another health issue with weight loss noted as a possible secondary effect. What research there is, it turns out, rarely meets rigorous scientific standards.<\/span><\/p>\n<h4>High-quality research finds little effect<\/h4>\n<p><span style=\"font-weight: 400;\">What quality research there is says they\u2019re not worth it.
